What’s Love Got to Do With It?

“One of the great myths in official Washington,” writes pollster and pundit Scott Rasmussen at Ballotpedia.org, “is that voters hate Congress but love their own representative.”

Working for term limits, boy have I heard this assertion a lot.

Oh, voters do hate Congress; this we know. Less than one in eight Americans approve of the job being done (or not) by Congress, according to a brand new The Economist/YouGov poll. 

The remaining question, however, is whether we really like our own congressperson. The correct answer appears to be: Not so much.

A recent ScottRasmussen.com national survey, conducted Feb. 1-2, 2019, found that less than one in four voters, only 23 percent, “actually think their own representative is the best person for the job.” A far larger percentage, 38 percent, believe “others in the District are more qualified.” 

It is certainly possible, of course, that folks could think there is someone better than their sitting congressperson and, nonetheless, still love their Rep.

Though, doesn’t “love” seem like way too strong a word?

The notion that we are consumed with amorous urges toward our own federal representative is evidenced only by the high re-election rate for incumbent congressmen. But those rates are more likely the result of the powerful advantages of incumbency.

Not gleeful adoration of “our” career politicians.

There is one way to test our level of devotion: Let us vote on term limits and see what happens.

It would lead to a new question: Where did our love go?

Old Dominions

A photo, found on Virginia Governor Ralph Northam’s 1984 medical school yearbook page, went viral. It was of a person in black-face next to another in a Ku Klux Klan sheet. In almost no time at all, Democrats and others quickly demanded that the governor resign.

Why the speed? 

The already-started presidential campaign? 

Or the likelihood that Democrats would experience no disadvantage should their governor step down?

Lt. Gov. Justin Fairfax, an up-and-comer in the Democratic Party, would take Northam’s place. And under Virginia’s gubernatorial term limits, Fairfax could run again for a full term after finishing the rest of this current term. 

With Virginia’s one-term limit, it would allow a rare option to run as an incumbent.

There’s a speed bump, though. Not necessarily the sexual assault allegation lodged against Fairfax, which he denies . . . and about which we know little. What’s certain? Fairfax is positioned far to the left of Northam — in a state that is still more purple than blue. 

A bitter feud with Laborers’ International Union of North America illustrates the problem. Mr. Fairfax has long opposed two pipelines that the union desperately desires. The union — a donor of $600,000 to Democrats in 2017 — demanded that candidate Northam remove Fairfax’s name and picture from mailers to union households. 

Northam complied

And got hit by charges of racism.

You see, Fairfax is black. 

Playing down the dis, Fairfax called it a “mistake”; others chose “mindboggling,” a “slap in the face,” and a signal that blacks “are expendable.”

Northam still won . . . with 87 percent support from black voters.

Should Northam finish his term, Lt. Gov. Fairfax would remain well positioned, but the race would be wide open. If Fairfax becomes governor, however, no Democrat will challenge him for fear of splitting the party.

Yet, come 2021, Fairfax is too far left to defeat a decent Republican . . . should one appear.

Beautiful Canary

New hope for Venezuela: A direct constitutional challenge against the horrific reign of socialist strongman Nicolás Maduro enjoys massive popular support and has quickly gained international recognition.

If 35-year-old National Assembly President Juan Guaidó, who launched the campaign, succeeds in restoring a democratic government, he should also restore term limits on the president, the National Assembly and other offices. 

Those limits were repealed through a 2009 constitutional referendum that paved the way for then-President Hugo Chavez to continue in power. With government domination of the media and a slanted ballot question, it was less than a fair election. Still, 54 percent voted to end the limits.

Today, I’m certain the majority would vote differently.

Venezuela makes me think of Nicaragua, likewise being looted and brutalized by a socialist thug. Hundreds have been killed in protests demanding that Nicaraguan President Daniel Ortega step down. I have friends with relatives in harm’s way.

Nicaragua is similar to Venezuela in another respect: The care and maintenance of dangerous concentrations of power ran smack into an established constitutional restraint known as term limits. 

In a widely condemned 2011 decision, the country’s supreme court “declared the constitution unconstitutional,” as the leader of the Nicaraguan Center for Defense of Human Rights put it. This permitted Ortega to run again. Three years later, the National Assembly jettisoned the limits from the constitution — without any vote of the people.

Term limits are needed everywhere, every city, state and nation across the globe. Even when a powerful despot breaks the limit, the violation at least serves as the coal miners’ dead canary, demonstrating that the political air has become too dirty for liberty to breathe.

None Dare Call It Careerism

Let’s build a wall, I said last week, between the Office of the President and all these emergency powers our Congress has recklessly given away to the chief executive.

After admittedly “scrambling to figure out” the emergency powers possessed by POTUS, the Washington Post’s editorial board lamented its discovery “that Congress has delegated a surprising amount of emergency or quasi-emergency power to the executive branch over the years, possibly too much.”

Possibly? Well . . . it is the Post.

Yet, the paper acknowledges, “The implications for constitutional government are potentially serious.”

The federal government currently operates under “31 presidentially declared national emergencies,” informs Post columnist Charles Lane. “[I]f Trump evades Congress’s refusal to fund a border wall by declaring a national emergency at the border . . . it would not be the first time a president took advantage of the inherent elasticity of the term.”

Congress last legislated on emergency presidential powers in 1976, a mere two years after Richard Nixon became the first president in U.S. history to resign in disgrace. Yet, even then, the law left presidential authority largely unchecked, and the term “emergency” completely undefined.

Why has Congress simply handed away so much power, writing laws with so little accountability? Has Congress been saddled with inexperienced rookies? No. There are no term limits. This is the product of very experienced career politicians.

Read between the lines. 

“Only Congress can reclaim the emergency powers it has granted the president,” Lane writes, adding . . . “assuming, of course, that lawmakers want the responsibility back, too.”

They don’t. They prefer their cushy careers.

The World Wants Term Limits

The Economist magazine has announced its “Country of the Year.” 

It’s Armenia.

The idea behind the award is to recognize the nation that has “improved the most” during the past year. The honorific implies no rosy assumptions about the future. Obviously, a country can backslide. The Economist’s editors admit that this proved to be the case with prior winners France and Myanmar.

This year, Malaysia and Ethiopia were in the running. Malaysians managed to oust a corrupt prime minister, and the new leader of Ethiopia has sought to encourage freedom of speech and liberalize the economy. But, all things considered, the magazine regards the advances in these countries to be too contradictory or uncertain to merit the Most Improved designation.

Progress seems more definitive in Armenia, where former President Serzh Sargsyan did his darnedest to escape presidential term limits — as is attempted by so many heads of state around the world.

Sometimes the power-grabbers succeed and sometimes they don’t. But everywhere, most voters oppose such shenanigans. They know how easy it is for an incumbent to shove his way to perpetual power no matter how unhappy they may be with him. Citizens know the value of term limits.

Armenia’s good news is that Sargysan’s attack on term limits failed — dramatically. He resigned after massive demonstrations. An opposition figure, Nikol Pashinyan, won power “on a wave of revulsion against corruption and incompetence. . . . A Putinesque potentate was rejected.”

Just what the world needs to see — a lot more often.

Mrs. Term Limits?

Do politicians oppose term limits on principle?

For the answer to be yes, we would first have to explain to them what principles are.

Sure, politicians adamantly oppose term limits that cut against their self-interest, i.e. apply to them. But they are often for term limits . . . when the limitation applies to others.

The exception to this rule? When limiting one’s own terms — or pledging to do so in the future — is absolutely essential in order to win an election.

Take the case of House Minority Leader Nancy Pelosi, who wishes to be elected Speaker in January by the new Democratic House majority.

Mrs. Pelosi is an unlikely candidate . . . for Mrs. Term Limits. And yet, she has agreed to support a new rule imposing term limits on leadership positions — even her own speakership.

What gives?

A number of newly elected congresspeople won their seats on a promise to change Washington. And to gain votes, they had pledged not to support the exceedingly unpopular, long-serving Swamp Creature for speaker.

Or should that be Mrs. Swamp Creature?

Now with Democrats comprising a narrow 17-seat majority in the new Congress, these young upstarts wield enough votes to deny Pelosi the position she covets.

So, against the objections of her longtime lieutenants, Pelosi has promised these “rebels” that she will not merely bring before her caucus a new rule imposing limits of three terms for leadership positions, including her own, but she also insists that even if that rule fails to win the support of the Democratic caucus, she will personally, voluntarily, abide by those limits.

Meet the Missus. Don’t ask about her previous status.

Hating the Senate

The longest-serving politician in Congress — ever — thinks he has the perfect reform to put American government back on track.

Former House Democrat John Dingell wants to abolish the Senate.

According to him, the United States should go unicameral.

The ancient bicameral tradition — which goes back to Sumer — is so old hat. He thinks that, these days, “in a nation of more than 325 million and 37 additional states, not only is that structure antiquated, it’s downright dangerous.”

Dangerous? Well, he has always hated the Senate. He sees it as a place where “good bills go to die.”

His new book explains this at length, but I confess: it would go against my principles to put any money into that man’s pocket by buying The Dean: The Best Seat in the House (2018). He almost personifies everything I’m against. His very career is an atrocity. In 1955, John Jr. took over the House seat from his father, a 22-year incumbent, and then six decades later, in 2015, basically bestowed it on his wife.

That’s 86 years and counting.

How many times did he swear to uphold the Constitution? And yet he doesn’t seem to understand that Article V, governing the amendment process, establishes one specific limitation: “no state, without its consent, shall be deprived of its equal suffrage in the Senate.”

Jettisoning the U.S. Senate would seem to be such a deprivation.

The opposite of this Dingelldorf reform would be more in keeping with the spirit of our system: term limits.

To keep anything like a John Dingell Sixty-year Stretch from ever occurring again.

Trump Should Look to Peru

Democracy can degrade into other things, even strong-man rule. To avoid such degradation, we have a ready prophylactic. Term limits. Which hamper would-be dictators-for-life, including entrenched oligarchs in the legislature.

Many countries illustrate the point. But take Peru, where the new head of state, Martin Vizcarra, has been combatting political corruption by supporting a referendum to impose term limits and other reforms on Peru’s Congress. Voters weigh in on December 9. 

The congressional term limit would be a ban on consecutive terms. Peru’s presidency itself is limited, too weakly in my judgment, by a ban on consecutive terms. A former president may run again after a term out of office. But this is much better than having no presidential term limits.

Vizcarra got the top job early this year when his predecessor resigned because of corruption charges. The former vice president wasn’t very popular at first. But Vizcarra’s fight against corruption and for legislative term limits has changed things. The new guy now enjoys a 61 percent approval rating.

May I offer a suggestion to our own head of state? 

Americans, too, are heartily sick of corrupt incumbents. 

We, too, would love to see congressional term limits. 

Instead of voicing only occasional strong support for efforts to impose them, President Trump could make it a crusade. Push for the idea as loudly and eloquently as he can, day in, day out. The future of the country is at stake. 

And it would boost his approval ratings.

The Seinfeld Referendum

There is an unmistakable connection between Washington State initiative guru Tim Eyman and New York City comedian Jerry Seinfeld.

Mr. Seinfeld gave viewers what they wanted for nine seasons as the star of the self-named 1990s hit television sitcom, Seinfeld. It was slyly defined as “a show about nothing.”

Meanwhile, Mr. Eyman has been giving voters what they want (psst: more choices) for even longer — initiating ten successful ballot measures in the last two decades. And, believe-it-or-not, Eyman’s latest ballot measure is also “about nothing.”

The Washington State Citizens’ Commission on Salaries for Elected Officials “is recommending raises over the next two years totaling 17.6 percent for legislators, 17.8 percent for judges, 6.6 percent for Gov. Jay Inslee, 13 percent for Lt. Gov. Cyrus Habib as well as increases for others,” the Statesman-Examiner (Colville, Washington) reports.

This is one of those faux citizens’ commissions. “It’s totally rigged,” Eyman tells supporters, adding that “one of [the commissioners] is actually the husband of a state supreme court justice!”

Eyman reminds his fellow citizens of the Evergreen State that, regardless of the size of any proposed pay hike, they possess “the absolute right” to a referendum vote on the matter.

“Politicians say they are just scraping by. I think they can make it,” mocks Eyman to reporters. “[Governor] Jay Inslee will have to scrape by with $354,000 over the next two years.”

Along with Spokane resident Jack Fagan and Spokane City Councilman Mike Fagan, Eyman prefiled a referendum to reverse these pay raises. It’s called the “Give Them Nothing!” Referendum.

Has a nice ring to it, no?

Suppressed Measure Woulda Won

Arkansas politicians and their cronies were terrified by Issue 3. So when this tough state legislative term limits measure was approved for the ballot, foes of citizen-controlled government sued to kill it.

Agreeing that thousands of already-approved signatures of bonafide registered voters must be tossed because of new, legislatively-imposed, byzantine, legal technicalities, the Arkansas Supreme Court ruled that the measure was unsuited for ballot. Yet it was too late to pull it.

The vote simply wouldn’t count, that’s all.

So, why was Issue 3 proposed?

A few years earlier, in 2014, lawmakers had posted a deceptive ballot question consisting of a laundry list of “ethics reforms.” Carefully obscured in the measure was a massive increase in legislative tenure. Sadly, the scam succeeded and voters passed the measure, which allows legislators now to serve up to 16 years (or more) in one seat.

To fix this, Issue 3 sought to impose a maximum of three two-year terms in the house, two four-year terms in the senate, and ten years on overall legislative service. It would also have prohibited lawmakers from sending future term limits measures to the ballot. 

After November 6, votes on Issue 3 did get reported in at least some counties. Max Brantley of the Arkansas Times notes that in Pulaski, Washington, and Pope Counties, the Yes vote for 3 exceeds 75 percent. I’m sure these counties are representative.

“I think the term limits crowd should try again,” Brantley says, “if the state motto is to be Regnat Populus rather than Regnat Lobbyist.”

Agreed.
