On June 14, 1777, U.S. Congress adopted the Stars and Stripes as the United States Flag.

My late friend Douglas Michael Miller observed that, in a libertarian order, the idea that a government could select a national flag or a national anthem would be utterly rejected. He imagined baseball games beginning with flags brought by attendees hurriedly run up and down flag poles, one after another, as members of the audience stood as sang whatever they wished.
The Congress could and can indeed select a flag for the United States, but it cannot rightfully select one for America.
