Depending upon the official outcomes of the 2022 Midterm Elections, the Democrats may act to increase the Court to thirteen Justices. Subsequently, any prospect of Republicans increasing it to fifteen will be decried as “power politics”. But the Court would have no reputation to be preserved in the wake of an increase to thirteen.

The size of the Court has varied from five to ten Justices.
